I can't speak for Adora, but I think this works like sampling music. She took the images from elsewhere and modified them to make avatars, and is hosting them at her own site. Hence they are her own artistic creation.

Sampling usually involves embedding someone else's work in your own. But the N'Chips, Devil, Reality Bites, Evolve, and the Evolution mounting the Christian fish have had minimal alteration, if any at all. As far as I can see, some have just been rotated a few degrees. She may have changed the file size and proportions a bit. Nothing has been added to them. Is that enough to make it honestly Adora's work? I certainly wouldn't call these cited examples "her own artistic creation."

Second of all, if you feel so passionately about it, I can't stop you not crediting. If I could remember the site I got them from, I would have said put that in the description instead. Kay peaches?

Is it Ring of Fire (http://www.rof.com/), perhaps? If so, Adora's versions seem quite different to me in color, resolution, sharpness, dimensions, geometry and shiney bits, so it's not like she just ganked a crappy, out of focus pic from the catalog and called it an avatar.
If you think these are stolen, then the Finding Nemo and X-Men avatars are too. I think they're all well within the bounds of fair use, myself.

I'd agree they are within the bounds of fair use, too. What just doesn't make sense to me is for Adora to then insist that people give her credit as if they are her designs. The fact is, she really did not give explicit credit to the original site she got them from; why expect others to do so for her?
Well, admittedly, not much makes sense to me when it comes to how people behave. I'm not surprised that I don't understand why it's worth a defense against the little bit of a challenge she was given.

Adora herself is the one who first said these images were stolen. However, that wasn't my point. I just think that asking people to give her credit for these images is inappropriate. Fair use does not include taking credit for other people's work.

Okay, this is the deal.
The reason I asked for credit on LJ was because, as mentioned, I couldn't remember where I got them from, and if anyone on LJ saw the icon and wanted to know where they could find the base images or badges themselves, they could follow the line of creation back and contact me (I'm actually looking for the site now... though it's proving difficult) and see if I had the info. These haven't been posted on my LJ for that reason- that I can't remember the original source. When I do find it, I might actually make a post. I'm posting it here because it's a private forum and therefore less chance of them becoming as diffused online compared to an LJ post.
I never ask for credit when I do most of my icons, but I simply did for these because of that. Believe me, don't believe me, whatever. If you want to get narky about it, I can't remember most of the sites I took the movie caps from for the avatars in the gallery credited under my name. But are you going to get ranty about the other icons as well, wade, or is this just another one of your isolated incidents?

I only brought up hotlinking because you said no hotlinking. I understand the reasons for not want them hotlinked, bandwidth and such, but every time someone brings this thread up all of yours are hotlinked to your own page, thus eating up bandwidth as well. You could've uploaded them as attachments instead.
Hotlinking as a legal issue is one of those rather grey areas. On the surface there would seem to be a copyright issue, but some court decisions have forbid website owners from going after people for deep-linking to other pages than their homepage, or even hotlinking, because they are not actually copying content and displaying as their own, it's just a link to the owner's own webpage.

Hotlinking doesn't refer to when someone posts a link to or posts an image hosted on their own site/account. It specifically refers to when someone else does it, ala SkepticJ's links in the erotic photo thread. Because it's specifically someone else using your bandwidth for their personal gain or pleasure.
For example, a friend of mine recently posted an image on her LJ and it started sucking almost 570MB bandwidth from her image hosting account. There was no way in hell it could have got that amount without someone hotlinking it/using the direct link from her account in some way, since she's never had that many visitors to her LJ, and is highly unlikely ever to. She had to take her images down and move them to another site to prevent people doing this.
If tomorrow my image hosting bandwidth went through the roof like that, I'd do the same thing.

Incidentally, with all this saving of other people's images to pix8 to avoid bandwidth leeching, do you credit each pic and provide a link to the homepage of the sites you nick the images from, or ask the image owner for permission to use the image or anything?

Hey, what can I say? I'm here to help.
Although, II (http://www.iidb.org)'s link to that site gives them some credit on any purchases you make, IIRC.
