Is this :biker: a motorcycle or a construction worker weilding a jackhammer?

I voted for the invalid Planet z, since there was no valid Planet X option.
At first glance I thought it was a jackhammer, but I immediately believed it was a motorcycle. With the right arm bending like someone gunning a throttle (which speeds his pace enough to make his helmet fall forward) and the apparent headlight, I think it is.

Points in favour of the motorbike: It looks like he's turning a twistgrip. Jackhammers have a lever control - I never saw one with a twistgrip. The headlight thing. He's looking forward. People using jackhammers look down at the point they're digging.
Points in favour of the jackhammer: The 'tyre' looks the wrong shape. The 'bike' appears to stop moving altogether as soon as he goes to right his helmet, even though he's not untwisted the twistgrip at that point. Who'd create a smilie biker viewed from this angle? However, if you were drawing someone using a jackhammer, this is exactly the viewing point you'd intitialy tend to choose. You can't see any engine or exhausts.
I can't decide. It could be either, or both.

I also thought it was a jackhammer at first. But once I looked closer, I immediately jumped over to the motorcycle camp. It was the headlight that sold me.

From an effete, non-motorcycle riding pseudo-intellectual, it's a bad rendition of what I suppose is supposed to be a rider on a motorcycle. I use the "gunning" the engine motion of the smiley's right hand and the presence of a headlight (plus, of course, the intentions of The Man, when it made it).
It fails in a couple of respects. Few, if any, motorcycle tires are pointed along the center tread. Then, if the rider guns the engine to up the speed, the helmet should not fall forward (that would happen during a abrupt breaking), but backwards.
And, if it's going to wear a helmet, at least strap the damned thing on.

Well, that's fair enough. No doubt the smilie will magically transmogrify (again) appropriately in the near future.

I should've recognized it as a motorcycle right away. It's a Harley Davidson FXLSCBHMS Road King. I was at the FastQuiffyLube slash brake and muffler shop not too long ago getting my truck's dirty oil exchanged for some clean oil. A dude on one of those two-wheeled tractors pulled up and parked it on its kickstand, leaving it idling while he went in and talked to the counter troll about some high speed chrome plated muffler bearings or a chrome donut holder or some other chrome doohickey they also sell there. In the five minutes or so he was in there, the thing was vibrating so much it slowly scribed a complete six inch circle in the concrete with it's kickstand. That's the motorcycle that's in the smiley, it isn't bouncing down the road, it's sitting there idling, vibrating up and down. My stupid Honda, you can't even tell it's running.

Doesn't that worry you? We ride a Honda, too, but you can hear it coming a mile away. Ya gotta be loud, we're hard enough to see as it is!! Put some pipes on that thing!!!

I ride the whisper quiet Honda Pacific Coast, it's a trademarked sound. Now with extra fweem! I prefer to ride like I'm invisible. If I get to thinking people that pull out in front of great big red trucks with flashing lights and LOUD sirens will see little old me, that's when I'm in trouble.
