View Full Version : Tomorrow, I'm an inmate.
Nil Desperandum
11-04-2004, 03:19 AM
I get court-martialed tomorrow. I'm going to jail for at least 4 months. They got immunity for the other party involved, so he is going to corroborate my confession and, thus, we are pleading guilty.
I know some will be curious:
Distribution of Ecstasy on divers occasion.
Illicit use of Ecstasy on divers occasion.
Illicit use of 2C-I, an analogue of a Schedule I substance. (Fucking Federal Analogue Laws!)
Illicit use of 2C-E, an analogue of a schedule I substance.
Reserve your moral judgements for another time, because I'm just about the most secure person you'll ever meet. No offense, but you can probably guess my rope is really short right now, and to say, especially on the eve of Bush's victory, that I do not give a fuck, is a mild understatement. It is so mild, that you could win an award with how mild that is.
Anyway, thank you for the fun times, albeit as short as they were. I'll miss you guys, and I'll get Jamie to post an addy. I know you don't know me, and I won't get e-mail, so if I don't get any letters, I'll understand. ;)
I normally like to slip through the cracks, but this forum has slipped through *MY* cracks, and as such, I feel I owe it to you to say thanks for being so great.
Goliath, please be here when I get back. :)
Everyone else, have some growth, have some fun, and if you are messaging from another country when I get back, I'll understand.
Here's to splitting rocks, making license plates, or doing laundry.

Well, shit. Good luck to you; do they make Hallmark cards for this or anything? If not, they should, because I'm not really sure what to say beyond, "dude, that sucks." :(

Make the best of your time, and come back with lots of things you learned to share with us.
Sorry, man that sucks big time.

Keep your spirits up as much as you can, Chris. You're a strong man.
Be polite, respectful, and contrite throughout the proceedings. Remember that at a guilty plea, you are accepting responsibility for your actions, not contesting the legality of them. Defiance has no place in your situation, and it will only harm you. Maintain your military bearing at all times and keep wearing your uniform as proudly as you can. The judge and the court-martial panel will likely take note. They might not help, but being and doing anything but all of those things can certainly hurt you at sentencing.
Remember Andy Dufresne while you're in confinement.
I'll be thinking of you. Good luck, and we'll see you here when you get home.

Chris, you be very, very careful, okay? Do what Cool Hand says and get the minimum, please. Four months will come and go quickly and you'll bounce back in through the columns into our warm embrace.
Best of luck to you.

Livius, they won't let me in because I'm part of the investigation. If I was in the courtroom, they'd make me testify against Chris, and there's no way I'd ever do that. On top of that, my character witness statement is being dismissed because I'm involved with the case. IT's like "Oooooooooh this Jamie character, I've seen her mentioned somewhere (in the investigation)" and it would basically be a big mess if I was in the room, getting torn to pieces along with Chris.
:glare: When he gets out, we're moving to Sweeden.

Why the hell would they make you testify when he's pleading guilty? To determine sentencing or something? Ugh. How utterly vile. I'm so sorry y'all are having to go through this nightmare, but I hear Sweden is lovely in the Spring.

If only we could get the judge and the prosecution to eat some pills. "Oh come here, Chris.. sit on my desk and lemme scratch your back.. You know what, let's just dismiss the case, as you were a non-violent drug offender and your incarceration will push murders, rapists and child molesters back on society "
Wouldn't that be nice:)

A court-martial is a bifurcated criminal trial. Although the two phases take place with the same composition of the panel (the military term for jury), with one phase immediately following the other, there is a distinct guilt phase and a sentencing phase. Thus, even in a guilty plea, in a court-martial like Chris', there is a trial to hear evidence and arguments relevant to an appropriate sentence. Both the government and the accused have an opportunity to call and examine witnesses, and to cross examine the witnesses for the opposing party. Both parties can introduce admissible documentary evidence and make arguments before the panel regarding an appropriate and permissible sentence.
In the military, the panel sentences the accused after deliberations, the judge approves or modifies the sentence for legal compliance with the UCMJ and other relevant law, and the court-martial convening authority, probably a Colonel in Chris' case, executes it by written order. Any term of confinement automatically reduces the convicted accused to the lowest rank and extends his or her term of enlistment in the armed service until after the sentence is completed or commuted.

pesci, it's not so much of a being "able to get out of the military" thing. He'll be unceremoniously discharged, presumably, as he's mentioned before, a Bad Conduct Discharge, which is not a Good Thing (TM).
Yeah, it'll suck, but it's only 4 months. Just try not to make waves. Do your time and move on. Good luck.
