No, they are not legal marriages. And common law couples do not have the same legal rights as real married couples. You obviously haven't studied the law. Common law widows, for example, are ineligible for veterans benefits. There are other examples, but why waste time on you? :D

And what are you talking about with ceremonies? What does that have to do with anything?

Earth to lizzeria, the ceremony and the proper documentation makes it legal.

Stop. Think. What is a prenuptial contract? Does any part of it require a marriage contract?

Uh, in case you haven't noticed, the word 'nuptial' means wedding vows and completion of the marriage contract.

If I'm not mistaken, a prenuptial contract is nothing more than a private contract between individuals, and to enter into a legal contract like that, again if I'm not mistaken, you have to be an adult.

Hmmm.... That is a likely surmise pregnant with implications for the rights of minors in states that allow minors to marry! :P

So no. My guess is that it would not be legally binding. Family court is strange and capricious, though. Depending on the situation, something like that might be taken into consideration.

If there is no marriage contract, there is no marriage. If there is a marriage contract, then states like SC and AL that allow 14 year olds to marry might also allow pre-nuptial contracts that excuse older men from any obligation to the girl after he tires of her. That sounds possible and like a bad scam.

Do you really want to start comparing things to the Taliban? Is this a line of thought you really want to open up?
That is precisely why I raised the matter. Marriage contracts protect both parties and the children. Without strong marriage contracts, one could pervert the institution of marriage as other cultures have done.

I invite other more thoughtful readers to consider the possibilies for harm and the ways to prevent harm in lowering the marriage age or in creating common law marriages without state regulation. As for lizz... well, thanks anyway. We've heard from you.
