Throughout history, and throughout the world, there have been cultures in which the education of, for example, girls has been considered unnecessary, even downright undesirable. The underlying assumption of the libertarian position on Home Schooling v Nanny State is that parents can be relied upon to act in the best interest of their children, but it just ain't so.
Once a society decides that women's* rights can be denied them in the home classroom, empowering judges to overule parents is a no-brainer, I reckon.
