Default That is not the law in Georgia

GA Judge Mocks Bailed-Out Bank In Foreclosure Case, Says It's Time To 'Stand Up' For Taxpayers | ThinkProgress

Judge rules that against banks motion to dismiss man's suit that the bank didn't help him under hamp and won't explain why even though they did take 20 billion dollars.

It makes me proud to be from GA today.

They did that to me to. Denied my modification request under HAMP with no explanation. Should I sue?

I am not in the trouble I was then, so I will not sue. I did however offer my assistance as a corroborative witness to these practices (or whatever) to a consumer attorney I communicate with here in AL, just on principle. I guarantee he's got a client that was denied modification then foreclosed on because of it.

BofA denied us a loan modification under HAMP even though we didn't even apply for one. LOL

Lazy ruling on a motion to dismiss. Judge is running for re-election.

I don't know whether this guy's up for retention or what, but it's hard to care after reading that opinion.

Quote:
A cynical judge might think that, if the guidelines clearly prevented Mr. Phillips from getting his modification, then U.S. Bank would have trotted out that fact in mathematic equations, pie charts, and bar graphs, all on 8 by 10 glossy photo paper, with circles and arrows and paragraphs on the back explaining each winning number.1 U.S. Bank's silence on this issue might heighten the suspicions of such a cynical jurist. I, on the other hand, am sure that nothing of the sort could be true. Maybe U.S. Bank no longer has any of the $20 billion dollars left, and so their lack of a written explanation might be attributed to some kind of ink reduction program to save money.

1Apologies to Arlo Guthrie, Alice's Restaurant

I got to "8 by 10 glossy" and thought, "This fucker knows Alice's Restaurant." And sho 'nuff ...

Of course, he also knows what causes of action are viable in cases such as this. I'm hoping the media keeps reporting on this one. Ideally, some hoity toity silk stocking law firm will recognize a golden good publicity opportunity and offer to represent Mr. Phillips pro bono.
