Which I think agrees with what you're saying, literacy in itself isn't a right, do I read you right?
But there shall be schools available freely without discrimination. The right to go to school, and what the original article is claiming, if I'm reading that right as well, is the Detroit schools have been deliberately allowed to rot.
What with Flint's water troubles, Michigan's looking a lot more like my adventures in Caracas. Actually, on Google Street View, Detroit looks worse.
But now I'm rambling.

This looks like a much better article, although I really think it's shitty to write a news article about a primary source without linking to that source if it's available. It's stupid. The press does this with articles about legislation all the time, writing around it and quoting little snippets, but not even linking to the actual full text of the legislation, despite it being public information. Same with this. They keep quoting little snippets of the lawsuit, but not even giving a link to the whole text. That should be publicly available somewhere, no?

And it probably failed in part because the court rejected the idea of measuring based on outcome rather than a more direct measure (although the suit cited many direct causes). There are plenty of outcome based performance measures we use to evaluate schools and teachers already, so it's not a complete stretch or anything, but it's apparently too big a leap for the courts still.
