This may be nit-picking, but I don't think that literacy is a right or could even be a right. On the other hand, access to a decent education and the opportunity to achieve literacy could and probably should be a right.

This looks like a much better article, although I really think it's shitty to write a news article about a primary source without linking to that source if it's available. It's stupid. The press does this with articles about legislation all the time, writing around it and quoting little snippets, but not even linking to the actual full text of the legislation, despite it being public information. Same with this. They keep quoting little snippets of the lawsuit, but not even giving a link to the whole text. That should be publicly available somewhere, no?

There are plenty of outcome based performance measures we use to evaluate schools and teachers already, so it's not a complete stretch or anything, but it's apparently too big a leap for the courts still.
