Law Separation of what and huh? You think?

Judge rules that annoying Christian vanity plate violates the separation of church and state.
Soon to be referred to as an activist judge, I'm sure.

License plates are form of government issued ID, so I don't think it's too much of a stretch for it to be a CSS issue. That being said, I have seen pro-life plates and other ones that would cross that line...so it's not unreasonable to assume there was no line. Or something.

Hey!

If they get to put their symbols and catchphrases on state license plates, I know goddess worshippers who'd like to put a big yoni picture and the phrase, "Come With Us" on their license plates.

If they do it for one, they have to do it for all...regardless.

Can Krishna devotees get a picture of a blue skinned god seducing milk maids?

How about the Satanists who want an inverted pentangle and billy's head on theirs?

I honestly don't see how it can be anything other than a CSS issue. Sometimes the Christians who push this bullshit have shit for brains....they just can't think at all, much less straight.

I love who filed to have the law declared unconstitutional:

But Kozloski said judges often order the loser to pay legal fees of the winner.

"That's standard procedure," Kozloski said. He said the winning attorneys would have to compute the fees.

Bauer said Currie's ruling discriminates against Christians.

"When you can express yourself as a non-Christian, and not as a Christian, there's a real disconnect," Bauer said. "The laws of our country are being abused."

The lawsuit was brought by [The Rev. Neal Jones, ...pastor of the Unitarian Universalist Fellowship of Columbia]; the Rev. Thomas Summers, a retired Methodist minister from Columbia; Sanford Marcus, rabbi emeritus of Tree of Life Congregation in Columbia; and the Rev. Robert M. Knight, pastor of First Christian Church in Charleston. Joining them in the suit were - the nonprofit Hindu American Foundation and the American-Arab-Anti-Discrimination Committee.

The defendants were Marcia Adams, director of the Department of Motor Vehicles, and Jon Ozmint, director of the Department of Corrections, because prison inmates make the license plates.

Neither Adams nor Ozmint had any comment.
Christians, Jews, and Hindus all agreed that Andre Bauer is an idiot.

Reverand Jones stated that he was not surprised, as he could tell the legislation was "blatantly unconstitutional".

And he's not even an elected official who ought to know better.

Political messages on state issued plates is a backhanded endorsement of the message. Be it a football team or god on the plate. I'm not sure that is something the government should be doing in any form. At most the plate can promote the state and that is about it.

Summers v. Adams, No. 3:08-2265-CMC (D.S.C. Nov. 10, 2009) (pdf, 57 pages).

Once again South Carolina lives down to Petigru's assessment that it's too large for a republic and too small for an insane asylum. It's not especially difficult to bulletproof blatant government endorsements of religion against Establishment Clause challenges, but the state legislature didn't even try in this case. Naming the law something other than the "I Believe" Act would have been a good start.
