I had thought about this in the past, then forgot about it, are any pro gay marriage lawyers using this argument?

Laws banning gay marriage are unconstitutional because they discriminate on the basis of gender. If same-sex marriage is forbidden, Anne is allowed to marry Bob, but Charles can't. Charles is denied the right to marry Bob, solely because Charles is a man. Denial of a legal right solely because of gender is the very essence of sex discrimination.

Laws banning gay marriage discriminate on the basis of gender even more clearly than on the basis of sexual orientation. Anne is still allowed to marry Charles, even if one of them happens to be gay or lesbian. Bob is denied that right whether he is gay or not. The Supreme Court has long held that laws discriminating based on gender must be presumed unconstitutional and invalidated unless the government can prove that they can pass rigorous, heightened judicial scrutiny.

Have any of the antigay talking heads ever tried to present any real argument on how gay marriage "devalues" marriage as a whole? How is that suppose to deter heterosexuals from getting married?

SB377 would remove the duty of confirming marriages from county probate judges and allow marriages to be recorded by the state after filing a simple contract between two people eligible to be married that is solemnized by a pastor, attorney, or other authorized witness.

This means that should the bill pass, only heterosexual couples will be eligible, but if gay marriage is legalized across the country by a U.S. Supreme Court ruling, that eligibility would be expanded to homosexual couples.

Though some are characterizing the bill as a reaction to the possibility of the state being required to perform and recognize marriages between same-sex couples, Albritton maintains he is simply removing the government from an area it never should have been in the first place.

“When you invite the state into those matters of personal or religious import, it creates difficulties,” Albritton told the AP. “Go back long, long ago in a galaxy far, far away. Early twentieth century, if you go back and look and try to find marriage licenses for your grandparents or great grandparents, you won’t find it. What you will find instead is where people have come in and recorded when a marriage has occurred.”

As long as they realize that opting the state out of the marriage business doesn't exempt them from treating homo couples differently from hetero couples with regard to state benefits.

I am for it too. I even expressed support for something along those lines afore. I think it is hilarious that they are so quick to trash the whole thing rather than share it with gays. I am surprised they didn't do it after Loving.

Also good for business as notaries and attorneys would be able to draft the contracts....giving them a new revenue stream.

Alabama's legislative rejection of the reasoning proffered by Michigan in Obergefell is also a new tax on marriage! This is the kind of tax that makes people think marriage is about something other than the children, and winds up destroying families.

How many people will decide that they just can't afford this new tax on marriage, and decide not to get married, and not love their children? This is the kind of unconstitutional injustice that happens when you "invite the state into those matters of personal or religious import" (but not like when you plant a huge ten commandments monument in front of the courthouse).
