I have no doubt that the marijuana legalization campaign is funded by the private prison industry, who know the federal prisons don't have nearly enough room for all the potheads the feds will bust because the potheads think it's legal.

If someone possesses and uses weed in accordance with Amendment 64, s/he has no criminal liability as a matter of state law.

However, the federal Controlled Substances Act remains "the supreme law of the land" for Supremacy Clause purposes. Weed is a Schedule 1 controlled substance under the federal law. If the federal government wants to prosecute the hypothetical person referenced above, it can. The state law provides no immunity from or defense to the federal charge.

We voted to decriminalize 1 oz or less of pot in Flint last night. Detroit had the same thing on the ballot but I don't know if it passed. When we legalized medical marijuana in Flint, it passed statewide in the next election or so. I imagine this measure might go statewide as well.

In accordance with the Justice Department's position in regard to illegal immigrants in Arizona, local law enforcement is under no obligation to enforce federal law, right? If so, the ATF and DEA are going to need a lot more agents.

From a practical standpoint, do you think the Feds will just look the other way for the most part, and concentrate on large traffickers or interstate transport whatever DEA dudes do all day, or do you see them forcing the issue by going after small local operations?

I see them forcing the issue at first, honestly. The Federal government won't want to appear soft on the issue now if they plan on stemming the tide of other states' decisions to decriminalize. They've got far too much money and personnel involved in this "war" to be ready to give in yet. The change will have to be gradual, IMHO, for it to happen at all.

Well they do go after medicinal suppliers of pot, marijuana pharmacies. Which are larger. Individuals not so much, but I wouldn't bring your "medicine" on an interstate flight.

What it comes down to enforcement wise is the likelihood that the feds would bother.

We already have statewide medical marijuana, plus it's decriminalized in Denver. What this means in a practical sense is that it is already not a big deal. You can get a ticket for smoking pot in Denver, but it's the lowest priority, so if you're smoking a joint in a park and the guy next to you throws a napkin on the ground, they're supposed to get that guy first.

They've been using the state law excuse for a while now to continue going after people for possession, but this should eliminate that.

Marijuana is still illegal on a federal level, so they could come after them, but that's also the case with medical marijuana, and we've got dispensaries everywhere.

I thought the funniest argument against legalization was that it'd made Colorado a tourist destination.

:nonstop: O NO NOT TOURISM. :nonstop:

Also, we already are. With the generous provisions of medical marijuana licenses, Colorado is already pretty well recognized for abundant, high quality weed. Our local Village Voice style paper has reviews of dispensaries just like restaurants.

So at this point, if the feds were to start cracking down, they'd a) get a lot of blowback, and b) never be able to get a handle on it anyway. I'm going to guess they probably won't bother.

With any luck this will help remind politicians here that we used to be ahead of the curve. They have been trying to limit coffeeshops here as much as they can in the last decade.

This will be interesting.
Hopefully it takes the target off California for awhile.

If it goes the way it has in California, it's gotten a lot easier to use pot but maybe harder to grow it or sell it. The Feds have been quietly hitting legit growers and sellers in an attempt to put a chill on process. To be legal you have to let the government know where you are and what you are moving. So they have an easy time walking in and kicking everything over at what they call an illegal grow operation. Corporations have been against it as well, cutting off pot purchases on plastic, making it a cash only industry right now. IMO the main driving force behind the current fed raids is the liquor industry (the top 3 companies own over 90% of the products) who sees pot as revenue eating competition.

In the short/medium term, drunk driving deaths should go down and pot quality should skyrocket.

Sadly that's similar to what many dispensaries in California thought. Over the last year or so the industry has gone from sunshine and cannipops to scared and a bit hushed thanks to the feds. The crackdown has put a number of large companies out of business. The industry is large enough in the bay area that the city of Oakland is fighting for one of the dispensaries in court because it's one of the cities top tax revenues, helping to keep the city afloat.

So far it sounds like the Feds haven't turned their giant eyeball to denver, yet.

We've had the Feds come in here, too. They do it all sneaky and quietlike for the most part, but we've had busts.

But ultimately, it doesn't make a dent in the industry, and it only solidifies public sentiment in favor of legalization.

The feds have intervened here and there, and I suspect they'll do that a few more times. I just don't think it'll get very far, and they'll have to give up eventually.

I happen to think it would be for the best if marijuana were legalized nationwide. I strongly suspect that this wave of legalization will eventually lead to a court fight at some point.

And the supporting evidence is... raids on dispensaries.

Look, I'm not saying those raids are good things. (I already knew about them, and have consistently opposed them). But the way you worded it is utterly beyond histrionic. If you expect people to take you seriously, you need to restrain your wording to things that are already happening. Try wording your posts more like Ari (who basically already said what is actually happening).
