Well the governor probably did swear to uphold the California constitution and this is part of it now, of course he also probably swore to uphold the US constitution which would take precedence and it seems they could legitimately claim that they see this as violating the US con. :dunno: I certainly know nothing of what legal arguments they could make.

Well, upholding the constitution does not include upholding a provision after it's been struck down. Of course the striking down isn't yet beyond appeal in this case, but Prop 8 is now at least prima facie unconstitutional. The Governor's obligation to uphold the legally binding elements of the constitution does not compel him to defend its prima facie unconstitutional (per federal judiciary) elements.

Or so it seems to me.

I find that end of the ordeal interesting. I'd much rather California at least make an effort to keep Prop 8 so that it goes to their Supreme Court and then possibly as far as the national Supreme Court. (But in my ignorance I don't know if that could happen.) Just so there's some ultimate finality to it rather than watching it die in the lower courts.

It will make it to SCOTUS eventually. Maybe in this case, depending on the standing rabbits to be pulled from asshats, like if Imperial County can come up with some kind of concrete, actual and non-abstract injury to some legally protectable interest that convinces the CoA to allow them to intervene on the appeal. (Interestingly, Imperial County is not using its own counsel. Rather, it has engaged Advocates for Faith and Freedom, "a conservative legal group based in Murietta that advocates for religious causes." Presumably there is a parenthetical (for Straight Folks) after the word "Freedom" there.)

Anyway, if not in this case, in another from another circuit or state.

I had kind of been half following the NY gubernatorial race but not really, at least not until Republican goober Paladino decided to tell some Jews about the Gays.

After saying that the media should apologize to him and also that he has a gay nephew, Paladino issued this poorly spelled half-assed apology to the Speedogrinding community. You can tell it's great from the very first paragraph.

Does one normally put salami on a pastrami sandwich? I thought that's why they called it a pastrami sandwich, 'cause that's what was on it. Put salami on it and you've got some kind of club sandwich or something, with several different meats...

Um, is the President's determination of Constitutionality meaningful?

Oh and LOL, I didn't know DOMA was actually a fucking law. Some states still allowed gay marriage so I assumed there was nothing blocking them from doing so. Who did the law affect, only Federal workers?
