Air Canada, Jazz & WestJet had filed the appeals.

Obese people have the right to two seats for the price of one on flights within Canada, the Supreme Court of Canada ruled on Thursday.

The high court declined to hear an appeal by Canadian airlines of a decision by the Canadian Transportation Agency that people who are "functionally disabled by obesity" deserve to have two seats for one fare.

The airlines had lost an appeal at the Federal Court of Appeal in May and had sought to launch a fresh appeal at the Supreme Court. The court's decision not to hear a new appeal means the one-person-one-fare policy stands.

Or at least a court order preventing them from seating me next to some other poor bastard with wide shoulders?

Huh. I'll be really interested to know if US courts will soon rule the same way. I work for an airline that shall not be named (lest I bring the airline's reputation into disrepute :giggle:) and our current policy on a full flight is that if an obese person "overhangs" the seat by two inches on either side and there are no other seats open on the plane, we can "give" them the opportunity to buy another seat and take a volunteer off the plane, or "offer" to let them go on the next plane if there are available seats on it. How generous of us, huh?

Thank the gods I have never had to do this.

I wonder how they'll define obese enough to require two seats?

Gee, here's an idea: make the seats large enough for normal-sized adults rather than just emaciated pygmies, then see how frequent the problem with obese passengers is.

I'm with you on that. It's a shame they never ask my opinion. :D

I've had a passenger who was probably 5'5" and 120 lbs come up to me and say, "I never fly on on airline X, their seats are even more cramped than your airline's seats and there's no room for my legs!" It's obvious they're trying to cram too many people onto an airplane if even the smaller-than-average people are uncomfortable.

The seats on most of my airline's planes are small, too, so it's hard to imagine worse.

If there is one thing we are good at it is not learning from other countries. Other countries are just places to make fun of as backwards or infected with socialism or to ignore whenever they do things better than us. We pretty much have half the world on ignore right now.
