Default Proposition 8 -- what now?

Now that people in California, Arkansas, Florida and Arizona are being coerced to accept only a heterosexual definition of marriage and denied the state privileges conferred upon those married folk, what now?

They can continue to fight to change the law.

They could also consider a paradigm shift and question whether the government should be defining "marriage" at all or granting privileges denied to single people.

I want to ask the lawyers here what the chances are of all these laws being chucked out on the grounds of equality, were the Supreme Court in the US more liberal? Can the case be made?

It seems clear to me that, if one person can enjoy the benefits of a legal arrangement with someone else, another person being denied that right basically does not have equal rights.

I actually support that even more marginal viewpoint. Seems fair to me. Though I can see why such a fight could never be won here.

Fairness doesn't even enter into it while it's squarely in the Never Gonna Fucking Happen column. The point is, Prop 8 was passed due to the conviction of scads of people who are holding onto their version of marriage via a death-grip. What's more, they're convinced that these nasty homos want to destroy that institution. So this group, of which these people are already irrationally afraid, NOW say that state-recognized marriage should be completely abolished? Yeah, that's really going to change their attitude.

It was very close this time -- I suspect it will probably get overturned in a ballot initiative at some future point. If the courts don't toss it out as being fundamentally incompatible with the country's constitution. (Which they eventually will, even if it's not soon.)
