Default Goodbye, liberty, we barely knew you

Journalist: ... let's talk about the Criminal Proceeds Act first of all, and what this says is instead of the Police having to prove that your wealth is criminally obtained, the citizen will have to prove it is not, so you are no longer innocent till you're proven guilty.
NZ Police Minister: It's fantastic isn't it?

Excuse me while I go puke.

that doesn't sound odd coming from a cop.

Not a cop, the politician in charge of the cops.

PAUL Yeah but the truth is, under the Criminal Proceeds Act, the Police can take your property if they suspect you're dodgy.

JUDITH But you’ve got the right to get it back, you’ve got the right to claim it, and the Police ….

PAUL Yeah but then you’ve got a whole matter of procedure to go through because the cops have decided they suspect you got the property criminally.

JUDITH Well actually Police would lose all credibility if they went round doing that unnecessarily. They’ve got a lot of leads, they know exactly who they're after, and they will be after them.
I hate that old "oh the cops won't abuse it because they would lose credibility" argument. Since when have the cops been motivated by preserving credibility?

I actually thought you had made that quote up to prove a point. But no, that's actually what she said. :stunned:

Wait, are you suggesting that people in countries other than America ever had liberty?

Cuz I was under the impression that we were the only ones.

I know this is sarcastic, but there's a bit of a point in here. We don't actually have the same level of constitutional safeguards you guys have. We've generally had de facto liberty, but there's not much legal recourse in the event a government does stuff like this. We have a supposed "Bill of Rights", but it's just a law, not something constitutional, which means that the government of the day can just repeal it with a majority vote if they like. IIRC certain government activities are excluded from it anyway. Not very useful. And there's nothing that stops legislation excluding itself from well-established common law principles either.

In principle I'd prefer this place to be a republic than the current setup, but since we seem to vote in people like this I don't really trust my fellow citizens to come up and support with a decent constitution.

The authorities here in the freedom-loving United States of America have been confiscating cash, motor vehicles, and even houses in the so-called drug war without due process or even charges being filed for quite some time.

In CA they reach in and scrape the DNA out of your mouth just for getting arrested.

My DNA is on file with the DOD for 70 years. When they took it they gave me a privacy act statement with the resources to have it taken down when my service time was up, but I totally lost it of course. I watch enough CSI to know that it will be totally useful to help them identify my mangled corpse when it washes up.
