I been sued, and won!
Thank you, Counselors and Kind Folk, for the advice back in January RE: "I'm being sued...".
Due to the information given here at FF- which led me to do a ton of research resulting in finding this most excellent blog, and a conversation with the attorney who writes the blog- along with Midland Credit's bad credit reporting practices and attempt to improperly serve me, as well as our evidence of attempts to verify our debt and pay it to the original creditor, the judge ruled in our favor. He didn't just dismiss it, either, he entered a judgment for the defendant.
So thank you!
These zombie debt buyers are filing millions of suits across the country, and most have little to no evidence validating their claims and assertions. People are getting sued for debts incurred by other people and fraudulent/identity theft related debts and ancient time-barred debts...and the debt buyers are getting default judgments in an estimated 80% of them (we saw 2 such default judgments entered today). If you or someone you know is sued based on such false, illegal, or incorrect claims, please know it can be fought!

I know exactly how you feel because I went through the same thing with an insurance giant more than a decade ago (trying to force me to pay for a vast array of repairs to someone's fucked up old car because I dinged his front bumper at low speed). I was earning peanuts but luckily I had a close friend who was an attorney helped me pro bono or whatever they call it.
At the time my magistrate uncle told me most insurance giants sue right or wrong because most of the little people get intimidated into paying, right or wrong. Its always nice to know you're the David that made them waste time and treasure only to get a big black eye.

It's a funny system. There was an attorney there representing two different debt collectors on three different cases, ours being one. From my research it seems they hire local "cover attorneys" who spend their whole day collecting default judgments on no shows. She even admitted to the judge that Midland Credit is known for giving their attorneys bad information and incomplete records, after he kinda interrupted my testimony to ask her if she had any documentation proving their claim.

Had the attorney not shown up, the case would have simply been dismissed...we had to actually go before the judge, get sworn in, answer the attorneys questions, and present a defense.

Thanks. I am just glad I researched the shit out of this and asked questions here (the account stated thing being the most important piece of info I got here). I was very confident presenting our defense. The judge even rolled his eyes at the attorney when I pointed out they had tried to serve me at a 3 year old address, so their supposedly mailing me a detailed accounting (which I never received) was in serious question...and THAT supposed mailing is what they based their claim of "account stated" on. The judge seemed very unimpressed by the plaintiff's claims. As I said he kinda just stopped me and asked the attorney "Do you have any documentation there in that pile?"
