Huh? Unusual circumstances is an understatement, but the facts either fit the elements of the crime or they don't. I agree with Ding that they probably don't, and a competent prosecutor shouldn't be using a "close enough" standard to bring charges.
Not that I think the boyfriend isn't a twit who deserves a slapping, but if a law wasn't broken, a prosecutor shouldn't pretend that it was.
