Re: RBG has died!
In theory, we have plenty of evidence for why we don't need to fill her position RIGHT NOW. I mean, it's literally within living memory. Plenty of those people on film and tape saying we should wait for the Will of the People.
But.
Fuck.

Re: RBG has died!
Christ. Condolences to Justice Ginburg's family and friends, and to every American who believes actual flesh and blood human beings should receive protection under the law.
We're already seeing Internet dumbasses pontificating about how the rapey alcoholic manbaby's nomination was fast-tracked and still took three months. We're about to find out what "fast tracked" really means.
So what'll it be? An uberconservative real judge or another fuck-you nomination, maybe Judge Wine Box from Faux News.

Re: RBG has died!
It will just makes Court packing an imperative and Dems are about to have all 3 branches and can kill the filibuster.
Simple majority to pack the court.
I love RBG and I literally weep for her, and this hardens my resolve to fight for justice.

Re: RBG has died!
In February 2016, close to nine months before the election, our p.o.s. hopefully-soon-to-be-former-Sen. Cory Gardner said of the vacancy created by Justice Scalia's death, "Again, I think we’re too close to the election. The president who is elected in November should be the one who makes this decision."
We're watching, motherfucker.

I look forward to a 13 member supreme court, it actually addresses some caseload issues the court has developed over the years locked in at 9.

I would really surprised if that happened. The Democrat way is just to roll over and take it and then act like things are normal when they get into power.

That's a great point. Opinion-writing these days means starting with the Code of Hammurabi and tracing every single development regarding the legal issue before the Court from then to this very goddamn minute. In a really big year, the Court decides maybe 70 cases on the merits. That's fucking ridiculous.
Won't happen, though. As Crumb correctly notes, Dems at the national level play seniors mixed doubles lawn bowling while the GOP beats them vigorously about the crotch with baseball bats and canoe paddles. Were it not for my beloved and effective Colorado and Juggalonia County Democratic Parties, there'd be no good reason for me to remain a Dem.

this is the Pollyanna in me, but I think change is occurring. Maybe we won't vote, maybe I am wrong.
But I think many people understand that Republicans are bad actors. I see the sharpening partisanship as signs that Republicans fuckshittery is radicalizing centrist or center left voters.
again, I am probably just a starry eyed panglossian dipshit, but I think that there will be real repercussions and that Moscow Mitch's Ginsburg Gambit will fuck him.

I can’t wait for Supreme court Justice and Attorney General Barr, or Nazi Stephen Miller, or Wife Daughter Ivanka to be rammed through by Mitch and the goons.
Beyond Trump, he’s the real problem, Mitch needs to go.

First off, I love your language, it is positively (and I mean this in the most complimentary way possible) Hunter S Thompsonian.
I also get how you feel. The Democrats haven't been right or effective at many times.
Perhaps, I am just younger and earlier in my cycle of identifying with the Democratic party, but I think the partisan shift is reason to hope. I think the dems were slow to warm to truly partisan politics, but the base grows more partisan because of GOP action.
Biden would run to the right of where he is, if he could, but the Democratic core isn't having that.
I think we can find the will.
Like I said above, I am probably wrong. I tend to be overly optimistic about humans.
We are in crisis but that crisis makes change possible.

Re: RBG has died!
Man, that sucks in all kinds of ways. From all accounts she was a trooper to hang on as long as she did.
I'm sure you've all seen the videos going around from 2016 already. Lindsey Graham saying "I hope you use my words against me in the furture...", Ted Cruz saying "It hasn't been done in 80 years, it's not done..." and that shite.
But like someone else on Twitter said "Imagine thinking the GOP could be shamed by hypocrisy"
I wish I could muster some of Bey's optimism, but things look pretty fucking bleak for the future. If I thought the election was going to be completely fair, I'd say Biden has like a 90%+ chance of winning. As it is, I'd say it's closer to 50-50. I really hope people come out and vote in record numbers and the GOP lose White House and the senate. It seems like the only real hope.
And it isn't much better in the UK.

Re: RBG has died!
RIP Ruth Bader Ginsburg. She was a powerful force for good, as Cornel West would say (and has probably said).
It seems clear that if the Democrats manage to pull off taking over the WH and Congress they could kill the filibuster and expand the court. I don't expect them to, but it would be possible (and nice). If they don't (and somehow a revolution is avoided) we're screwed.
I'm inclined to agree with Sam Seder that SCOTUS were likely to pass on settling any election contest because all but one swing state (iirc) has a Republican majority SC that will do their dirty work for them so they can maintain the facade of objectivity. So I don't think losing RBG in this specific case makes much of a difference.
If Trump somehow steals the election in November I will lose all optimism and might actually emigrate to Australia or something once they're allowing Americans in again.
Then again with the climate crisis, increasing threat of nuclear war, and fascism on the rise all over the world ... well, if ever the cliche about rearranging deck chairs on the Titanic was relevant, it's now.

Re: RBG has died!
My suspicion is that McConnell will not hold hearings before the election.
It's not that Trump's or McConnell's loyalists care in the slightest about the rampant hypocrisy that holding a vote before the election would entail. But ... there are several Republicans -- including McConnell himself -- who face the prospect of losing their re-election bids. Displaying such blatant hypocrisy and partisanship might turn off enough "swing" voters to cause Republicans to lose those races.
What I suspect WILL happen is that McConnell will wait until after the election to hold a vote. Then, right after the election, and regardless of who wins -- he'll try to force through Trump's preferred nominee before the changeover of power.
That way, McConnell will get to have his cake and eat it too.
Am I being too cynical? Where McConnell and Trump are concerned, I don't think that's possible.
