Re: Republicans suck
Simon & Schuster had an agreement to publish a book penned by GOP POS Senator Josh Hawley called The Tyranny of Big Tech, which is apparently all about social media being cruel to Republicans and other various and sundry Nazis. After Hawley's disgraceful insurrectionist horseshit on Wednesday, S&S canceled publication.
Hawley's reasoned, measured response:
Quote:
This could not be more Orwellian. Simon & Schuster is canceling my contract because I was representing constituents, leading a debate on the Senate floor on voter integrity, which they have now decided to redefine as sedition. Let me be clear, this is not just a contract dispute. It's a direct assault on the First Amendment. Only approved speech can now be published. This is the Left looking to cancel everyone they don't approve of. I will fight this cancel culture with everything I have. We'll see you in court.
|
Ya learn something new every day. Until reading that, I had no idea that the First Amendment applied to private companies and guaranteed book deals.
As seen on the internet: "This is not Orwellian. Orwell got published."

I'm gonna go out on a limb and guess that Simon & Schuster just might have made provision for alternative dispute resolution such that it is unlikely that they will be seen in court.

That there is a sturdy limb. There is p. much no chance whatsoever that the agreement lacks a mandatory binding arbitration provision.
Also vanishingly small are the odds that the contract lacks a provision under which the publisher can renege if it the author engages in conduct that the publisher, it its sole discretion, of course, deems detrimental to Simon & Schuster.
And, of course, the agreement surely contains the lawyer's best friend, a fee shifting clause under which the prevailing party in an lawsuit or arbitration arising out of or otherwise relating to the contract can collect its attorney fees and other litigation expenses from the loser. Even of no such provision appears in the agreement (which, ludicrous), the Federal Arbitration Act and its state law clones all contain fee shifting statutes.
So yeah, Joshy. See ya in court.

Re: Republicans suck
I now have the mental image of Mr Hawley sitting on said sturdy limb with a saw, busily cutting through it, apparently unaware that he's on the unsupported side of the cut.
I don't know why that image should spring to mind. It's not like anything resembling that is happening in the country I currently live in.

Re: Republicans suck
But that just means they are being less public about their right-wing views. That's been going on since before the polls for the Clinton-Dump election and the Brexit vote got it so wrong. It doesn't mean they won't carry on voting for more rights for white billionaires and none for poor brown lesbian immigrant Muslims.
