Bush's Dred Scott Idiocy = Anti-Abortion Code?

Yeah Bush's hero Scalia made the comparison in Casey, gazing wistfully at Justice Taney's portrait, painted two years after Dred Scott, noting the haunted look on Taney's face and suggesting that having abortions available is going to start another Civil War, I guess.

Scalia also wrote there, "We should get out of this area, where we have no right to be, and where we do neither ourselves nor the country any good by remaining," which is more in keeping with Kerry's response to the abortion question at the debate than Bush the social (read: judicial) activist's.
