Romney, along with members of the audience, laughed at the joke and later thanked Walpin for the ''very generous introduction."

If I'm not mistaken, the Massachusetts Supreme Judicial Court's opinion on same-sex marriage was an advisory opinion, that is, it was formally solicited by the MA legislature. So if you're not going to like the answer, don't ask the question.
Advisory opinions are solicited by state legislatures in order to assist lawmakers in crafting legislation prior to its passage. They are forbidden at the federal level by the Constitution's "case or controversy" requirement.
