Default Michael Moore being sued by troop in Fahrenheit 9/11.

The Moore Controversy continues.

http://www.boston.com/news/local/mas...ahrenheit_911/

Upshot is that the soldier is sueing for $85million (How he got the figure, I don't know) on the grounds that Moore used his comments describing his injury in context of voicing complaints about the war effort.

"What happened?"
"Our base was attacked by a giant socialist weasel..."

In an interview on FOX News the soldier said that his lawyers came up with the figure. I presume they are working on a contingency basis.

Here is an old article (2004) on Sgt. Peter Damon and how he is coping with his injuries.

I think the figure is a bit excessive. Is it actually illegal to take news clips like that and use them? I know this is probably a really stupid question.

In the news clip he did say he would learn a new way to get by without the use of his hands, a large lawsuit is one way to, I suppose. :yup:

Someone educate me. I knew a man who lost both legs back in Viet Nam. He received a check for life to support himself with from the military/government. He received his medical care for life from the VetAdmin.

Are we no longer supporting our maimed vets anymore? Is this man not getting a check every month in which to live on? Sure, if he wants to work he should, but he's making like he's impoverished. Our vets used to buy their own homes with help from the VA, now we aren't helping them so they can buy a home?

I don't know what the legal standards would be. Did Moore get permission to use the NBC clip? Did the guy give permission to NBC to air the flim of him?

You know what would be funny as hell? If this just opened the floodgates, and everyone who was misrepresented, quotemined, or had something they said or did taken out of context in the media sued for 85 million dollars.

It's an excellent question.

I can't find a copy of the complaint online, but I suspect its legal claims are a combination of privacy, misrepresentation, defamation, misappropration of his image, and who knows all what other issues, maybe even a copyright claim.

Apparently $10 million of the requested damages are for his wife's mental anguish and suffering, the hallmark object of your average tort reformer's outrage.

Ask tort reform advocate and slimebag Trent Lott.

He's joined a class-action lawsuit against insurance companies .

Over the years, Mississippi senator Trent Lott made a name for himself as an opponent of lawsuit “abuse,” decrying his home state as “the center of jackpot justice” and declaring, “What disgusts me most is the lawyers that the abuse has made super-wealthy.” That was then. After Hurricane Katrina ruined his Gulf Coast home, Lott changed his tune, joining thousands of Mississippians in a class-action lawsuit against their insurance companies. The suit is headed by legendary plaintiffs’ lawyer Richard Scruggs, who observed, “Funny how frivolous lawsuits stop being frivolous when it’s you.”

In for a penny, in for a pound.

What's the bets on out of court settlement?

Need to see the complaint. Moore et al may win summary judgment long before the issue of settlement arises.
