It's not a hate crime because being a Marine isn't one of the protected groups; being a Marine is not a race, a religion*, a sexual orientation, a disability [necessarily], ethnicity, a nationality (see immigrants being offered citizenship for serving), an age, a gender, gender identity, or a political affiliation.


*Their code, "Unit, Corps, God, Country" kind of puts it above religion.
